保養條款
KITS-A Company. (“KITS-A”) 保證據此零售的硬體產品(“產品”)沒有材料和工藝上的缺陷，不會因此在正常使用的情況下發生產品損壞。所依據的條款如下：
1. 保養協議僅限於購買本產品的原始購買者和本保養協議的執有者(“您”),而不能轉讓給後來的購買者。
2. 您必須提供標有日期的收據及保養卡(或保標貼)，作為適用於此保養協議的購買憑證 。
3. 保養協議只適用於產品在香港／澳門地區購買，並僅限於從授權的零售商處購買的產品，不包括二手貨或用作贈品之產品。
4. 在保養期內(如下文所述), KITS-A可根據現有條件，在必要時進行維修，將有缺陷的零件或任何不能正確工作的零件更換為新零件或良品零件。
5. 產品的保養期一般為主機十二(12)個月，配件為一個月(如電池，耳機，連接線，變壓器…等)，但個別產品會有所不同，如零售之耳機，請參閱隨產品附上之保養卡或保養標貼。
6. KITS-A不保證產品不會出現作業中斷或作業錯誤的問題。KITS-A沒有使產品在所有的作業環境下都能得到支援的義務，包括但不限於與所有軟硬體及其將來版本的相容性問題。
7. 關於產品的資料儲存問題： 對於儲存在產品上的任何資料發生遺失，刪除或無法存取的問題，KITS-A概不負責，也不承擔任何責任。在維修期間，產品上的所有資料都會被刪除。您在將產品運送給KITS-A之前，應當刪除所有儲存在產品的資料，或製作一份複本。
8. 保養協議不適用於：
a. 由於正常的耗損、非正常的使用或環境條件、錯誤使用、粗心、濫用、事故、不當處置或儲存、暴露於潮濕環境下、未經許可的改裝或維修、不正確的安裝、錯誤使用電源、過大的物理和電學壓力、使用者的錯誤、與指令不相容、以及其他不屬於 SPEED 的責任的動作而造成的後果，包括運輸過程中的損壞或遺失。
b. 由於外部原因，如洪水、風暴、火、沙、泥污、地震等不可抗力，以及暴露於日光、惡劣的天氣、潮濕、熱源或腐蝕性的環境、電力突波、電池遺漏、盜竊而造成的損壞.
c. 由於以下原因造成的資料損壞或流失：(i)作業系統/軟硬體其及未來版本的相容性問題，(ii)感染了病毒，木馬或記憶體內容被破壞的電腦，(iii)產品的故障或缺陷。
d. 任何產品中之LCD螢幕之亮（暗）點，五點或以下（包含）為正常狀況，不在更換新品及維修之範圍內。亮/暗點說明 (i)暗點： 在任何顏色的螢幕桌面背景下，都不會發光。(ii)亮點： 在黑色螢幕桌面背景下，發生不正常顯示持續發亮的光點，其發亮光點可能是白色或其他顏色。
e. 偽造的產品，或隨產品一並提供的物品。
f. 任何序號或保養封條已被改變、毀損或移除的產品
9. 根據保養協議，KITS-A承擔的責任範圍，為產品返還進行維修時的實際市場價值(例如，產品的購買價格減去合理使用損耗費用要少)。對於任何其他的損壞或遺失的情況， KITS-A不予負責。上述賠償是對於違反保養協議的專有賠償。任何對於違反保養協議而採取的行為或法律訴訟都必須在產品購買之日起十八(18)個月內進行。
10. 上述的保養協議是唯一而專有的補償，並替代所有其他明示或暗示的擔保。在適用法律允許範圍內，KITS-A 聲明不提供任何用於特定目的適銷性或產品使用的暗示擔保。如果這一聲明為適用法律禁止，暗示擔保責任僅將限於上述書面規定的保養期內。
11. 對於以下各項，KITS-A將不予負責：任何間接的，事故性的，特殊的，刑罰性的及其帶來的傷害，或損失，包括但不限於利潤，存款，資料，使用功能和第三方財產的損失，因使用此產品（或相關事由）以及違反保養協議而對財產或人身造成的傷害（包括死亡），違反協議，忽視，曲解或在規定之外過嚴的要求其責任（即使 KITS-A 已經指出此類傷害的可能性）。
12. 這是您和 KITS-A之間的保養協議全文，用於取代所有先前的和同時期的正式和非正式的書面或口頭協議，沒有其他未在此列出表述，承諾或條款具有修改這些條款的效力。
WARRANTY TARMS
KITS-A Company. (“KITS-A”) warrants that the retail hardware product herein (“Product”) is free of material defects in materials and workmanship that result in Product failure during normal usage, according to the following terms and conditions:
1. The limited warranty extends only to the original end-user purchaser and holder of this warranty (“You” or “Your”) and is not transferable or assignable to any subsequent purchaser.
2. You must provide proof of purchase of the Product by a dated itemized receipt to be eligible for this limited warranty. The original Warranty Card (if any) or Warranty Label (if applicable) must be presented for service.
3. The limited warranty is ONLY applicable in HONG KONG or MACAU where the product was purchased from an authorized retailer and excludes any product that has not been purchased as new.
4. During the Warranty Period (as provided below), KITS-A will repair, or replace, at KITS-A’s sole option, any defective parts or any parts that will not properly operate for their intended purpose with new or refurbished parts if such repair or replacement is needed.
5. The standard warranty period is 12 months and the warranty period of accessories such as batteries, connection cables, earphone, power adapter, battery charger etc is one month warranty , but may vary from products to products (eg. retail pack earphone). Please refer to the Warranty Card or Warranty Label included with the products.
6. KITS-A does not warrant uninterrupted or error-free operation of the Product. KITS-A is not under any obligation to support the Product for all operating environments, including but not limited to, interoperability with all current and/or future versions of software or hardware.
7. For Products that are capable of storing data (such as Music player, PMP and etc…): KITS-A is not responsible or liable for any data stored on the Product that is lost, deleted, or is otherwise inaccessible. All data will be deleted from the Product during repairs. You should remove or make a backup copy of any data stored on the Product prior to shipping the Product to KITS-A.
8. The limited warranty does not apply to:
a) Damage caused by normal wear and tear, abnormal use or conditions, misuse, neglect, abuse, accident, improper handling or storage, exposure to moisture, unauthorized modifications, alterations, or repairs, improper installation, improper use of any electrical source, undue physical or electrical stress, operator error, non-compliance with instructions or other acts which are not the fault of KITS-A, including damage or loss during shipment.
b) Damage from external causes such as floods, storms, fires, sand, dirt, earthquakes, an Act of God, exposure to sunlight, weather, moisture, heat, or corrosive environments, electrical surges, battery leakage, theft, or damage caused by the connection to other products not recommended for interconnection by KITS-A.
c) Damage or loss of data due to (i) interoperability with current and/or future versions of operating systems or other current and/or future software and hardware, (ii) a computer virus, worm, Trojan horse or memory content corruption, or (iii) malfunction or defect of the Product.
d) Due to the complexity of liquid crystal displays on handheld devices, dead or bright pixels may sometimes occur. If the following occurs within warranty period, then you can ask to replace the LCD at our authorized service centre. (i) 3 or more dead/bright pixels anywhere on the liquid crystal display.
e) Counterfeit products or any accompanying products that is not produced by KITS-A.
f) Any Product that has had its cover case, serial number, warranty label, warranty seal altered, defaced or removed.
g) Any defect occurring after the expiration of the Warranty Period.
9.KITS-A’s limit of liability under the limited warranty is the actual cash value of the Product at the time You return the Product for repair (e.g., the purchase price of the Product less a reasonable amount for usage). KITS-A will not be liable for any other losses or damages. These remedies are Your exclusive remedies for breach of warranty. Any action or lawsuit for breach of warranty must be commenced within eighteen (18) months following the purchase of the Product.
10. THE FOREGOING LIMITED WARRANTY IS YOUR SOLE AND EXCLUSIVE REMEMDY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. TO THE EXTENT PERMITTED BY APPLICABLE LAW, KITS-A HEREBY DISCLAIMS THE APPLICABILITY OF ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR USE FOR THE PRODUCT. IF SUCH A DISCLAIMER IS PROHIBITED BY APPLICABLE LAW, THE IMPLIED WARRANTY IS LIMITED TO THE DURATION OF THE FOREGOING LIMITED WRITTEN WARRANTY.
11. KITS-A WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, SAVINGS, DATA, OR LOSS OF USE, ANY THIRD PARTY CLAIMS, AND ANY INJURY TO PROPERTY OR BODILY INJURY (INCLUDING DEATH) TO ANY PERSON, ARISING FROM OR RELATING TO THE USE OF THIS PRODUCT OR ARISING FROM BREACH OF THE WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, TORT, OR STRICT LIABILITY, EVEN IF KITS-A HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. This is the entire warranty between You and KITS-A and supercedes all prior and contemporaneous agreements or understandings, oral or written, relating to the Product, and no representation, promise or condition not contained herein will modify these terms.
